These Terms and Conditions (“Terms”) govern the use of KC Dry Cleaning’s services. By placing an order with KC Dry Cleaning, you agree to abide by these Terms. KC Dry Cleaning reserves the right to amend these Terms at any time, and the latest version available on our website shall apply to your order. These Terms will pertain to the following three services offered by KC Dry Cleaning: (1) WASH & FOLD (W&F); (2) WASH & STEAM (W&S); and (3) DRY CLEANING (DC). Where expressly stated, some Terms may pertain to a particular service(s). Where not expressly stated, a Term should be interpreted as pertaining to all services.

1. Order Acceptance: Placing an order at any KC Dry Cleaning location constitutes acceptance of these Terms.
2. Order Cancellation KC Dry Cleaning reserves the right to cancel your order under the following circumstances:
   1. Events beyond our control.
   2. Failure to make items available for collection (Pick Up & Delivery).
   3. Any discrepancies with your order, including damaged items or items not meeting our acceptance criteria.
3. Release of Orders: Customer orders will be released once payment is received in full. KC Dry Cleaning reserves the right to withhold orders until full payment is received.
4. Pricing: Current pricing is outlined on our website’s pricing calculator. Additional charges may apply.
5. Payment: Payment is accepted via Credit Card, Debit Card, Cash, and via our KC Dry Cleaning App or online portal. Merchant fees may apply.
6. Damaged Items:
   1. WASH & FOLD and WASH & STEAM ONLY: KC Dry Cleaning is not responsible for any damage to your garments including, but not limited to: shrinkage/stretching, colour loss/fading/transfer or deterioration. KC Dry Cleaning accepts no responsibility for items damaged due to the presence of foreign objects left in clothing items. Within the W&F and W&S services, all articles will be washed and tumble dried. It is the customer’s responsibility to ensure that all articles in these services are washable and tumble dryable.
   2. DRY CLEANING ONLY: Where an article is damaged as a result of KC Dry Cleaning failing to follow the care label of the article, KC Dry Cleaning will be liable for the depreciated value of the article as determined by The Fair Claims Guide.
7. Lost Items: 
   1. WASH & FOLD ONLY: All articles in the W&F services will be processed in bulk, not individually identified (“batch”). If it is demonstrated that a total batch is missing, KC Dry Cleaning will be liable for the depreciated value of the articles included in the batch (as determined by The Fair Claims Guide), up to a maximum value of 10x the cleaning cost. For the avoidance of doubt, if it is proven that a batch is misplaced; or damaged through the negligence of KC Dry Cleaning; and the cleaning cost of the bag was $50.00; KC Dry Cleaning’s maximum liability will be $500.00.
   2. WASH & STEAM ONLY: If it is demonstrated that an article within the W&S service is missing, KC Dry Cleaning will be liable for the depreciated value of the article (as determined by The Fair Claims Guide), up to a maximum value of 10x the cleaning cost. For the avoidance of doubt, if it is proven that an article is misplaced; or damaged through the negligence of KC Dry Cleaning; and the cleaning cost of the article was $5.00; KC Dry Cleaning’s maximum liability will be $50.00.
   3. DRY CLEANING ONLY: If it is demonstrated that an article within the DC service is missing, KC Dry Cleaning will be liable for the depreciated value of the article as determined by The Fair Claims Guide.
8. Limitation of Liability KC Dry Cleaning expressly disclaims liability for any loss of profit, business interruption, or loss of business opportunity arising from the use of our services. Customers acknowledge and accept that KC Dry Cleaning shall not be held responsible for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, regardless of the circumstances.
9. Special Care Items: Customers must inform us of any items requiring special care. Failure to do so may result in washing according to the care label or normal laundry process. KC Dry Cleaning may suggest alternative services at our discretion that better suit your garment which may incur additional fees. KC Dry Cleaning will inform the customer of these fees prior to processing.
10. Stain Removal KC Dry Cleaning cannot guarantee the removal of stains.
11. Consumer Guarantees: KC Dry Cleaning abides by consumer guarantees mandated under the Australian Consumer Law to ensure the rights and protections of our customers.
12. Personal Information: We handle personal information provided to us with the utmost care and confidentiality. This information is used solely for laundry services, payment processing, and direct promotional communications, unless otherwise specified by the customer.
13. Event Outside Our Control KC Dry Cleaning shall not be held liable for any failure to fulfill our obligations under these Terms due to circumstances beyond our control, including but not limited to natural disasters, government actions, or labour disputes.
14. Entire Agreement: These Terms serve as the comprehensive agreement between the customer and KC Dry Cleaning, overriding any prior agreements or arrangements.
15. Waiver: Any failure by KC Dry Cleaning to enforce a right or provision under these Terms does not constitute a waiver of that right or provision.
16. Assignment KC Dry Cleaning reserves the right to assign or transfer its rights and obligations under these Terms without requiring consent from the customer.
17. Severability In the event that any provision of these Terms is deemed invalid or unenforceable by a court of law, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
18. Governing Law: These Terms are governed by the laws of South Australia, and any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the South Australian courts.
